Solved that at least!

LOL, yeah. Ok, so if the user is NOT allowed to post in full HTML (only filtered) and the post itself is made in FULL or PHP mode, then drupal is kind and prevents the user from editing the post

So I need to use format: 1 as my default for the formatting.
